  1. Student Eligibility and Parental Consent Policy

Because many of our students are minors, If It Is Math™ maintains strict policies regarding account creation and parental consent:

  • Accounts for Minors (Under 18): Students under the age of 18 are permitted to use our Services and create accounts only with parental or guardian consent. If you are under 18, a parent or legal guardian must agree to these Terms on your behalf. We will notify the parent or guardian via the provided email address upon the minor’s account registration as a safeguard.
  • Upper Elementary Students: For our youngest learners (such as those in the Transcenders program or other elementary-level offerings), accounts must be created by a parent or legal guardian. The parent/guardian should register the child, provide accurate information, and supervise the child’s use of the Services. By creating an account for an upper-elementary student, the parent/guardian represents that they are the child’s legal caregiver and consent to the child’s participation.
  • Parental Responsibility: Where a student user is a minor, the parent or guardian is considered the legal contracting party to this agreement. The parent/guardian shall be responsible for the minor’s compliance with these Terms and for all use of the account. Credit Card Consent: If a payment method (such as a credit or debit card) belonging to a parent or guardian is used to purchase any Service for a minor, such use is deemed to constitute that parent/guardian’s consent to the minor’s use of the Service and agreement to these Terms.
  • Children Under 13: In compliance with child online privacy regulations, we do not knowingly allow children under the age of 13 to create accounts or provide personal information without parental consent. If you are under 13, your parent or guardian must create the account on your behalf and consent to your use of the Services. If If It Is Math™ learns that we have collected personal information from a child under 13 without parental consent, we will deactivate the account and delete such information as quickly as possible.
  • Accuracy of Information: Whether you are a parent registering on behalf of a minor or a student user, you agree to provide truthful, accurate, and complete information during account setup. If we discover that any required information was falsified or omitted (for example, misrepresenting one’s age), we may terminate the account immediately.

By allowing a minor to use our Services, the parent or guardian is providing consent for the minor’s participation and is agreeing to these Terms in full. We reserve the right to request verifiable parental consent or additional documentation for younger students as needed to ensure compliance with applicable laws. We may require verifiable parental consent (such as confirmation via payment card, signed consent form, or another method compliant with COPPA or applicable law).

  1. Account Registration and User Responsibilities

When you register for an account with If It Is Math™, you agree to the following rules and responsibilities regarding your account usage:

  • Single User Account: Account access is granted on a per-user (per student) basis. Each account is intended for one student only, and login credentials must not be shared with others. You agree that you will not allow anyone else to access the courses or materials through your account, except a parent/guardian monitoring a minor student’s progress. Unauthorized sharing of accounts or course materials is a violation of these Terms. We reserve the right to suspend or terminate accounts that we suspect are being used by multiple individuals or are otherwise misused.
  • Account Security: You are responsible for maintaining the confidentiality of your account login and password. You must not share your password or allow others to use your account. You agree to notify us immediately of any unauthorized access or use of your account. If It Is Math™ is not liable for any loss or damage arising from your failure to secure your account.
  • Responsibility for Activities: You are responsible for all activities that occur under your account or password. This includes any content uploaded, messages sent, or actions taken through your account. If you are a parent/guardian of a minor, you are responsible for the minor’s activities on the account. Academic Integrity: You agree to use the Service for lawful, educational purposes. Cheating, plagiarism, or any form of academic dishonesty (such as seeking unauthorized help on practice tests or sharing answers) is strictly prohibited and is grounds for account termination.
  • Accurate Personal Information: You agree to keep your registration information (including email and contact info) up-to-date. We may use the email on record to send important account notices, parent notifications, or updates about the course.
  • Technical Requirements: You are responsible for ensuring you have the necessary hardware, software, and internet connectivity to access the online Services. We are not responsible for any inability to access the Services due to your equipment or internet service.

By creating an account, you agree to abide by these rules. Violation of any of these account usage rules may result in suspension or termination of your account at our discretion (see Termination of Service below). You also acknowledge that you are responsible for any consequences arising from account misuse.

  1. Payments, Fees, and Refund Policy

All fees for If It Is Math™ courses and services are as described at the time of purchase or enrollment. By enrolling in a course or purchasing a service, you agree to pay the indicated fees and any applicable taxes.

  • Payment Authorization: Payments must be made via the approved payment methods (e.g., credit card, debit card, or other methods we support). By providing payment information, you represent that you are authorized to use the payment method and you authorize us (or our third-party payment processor) to charge the full amount of the purchase, including any applicable taxes or transaction fees.
  • Access to Services: We will grant you access to the purchased course or service once payment is confirmed. Access to paid content is typically time-limited to the duration of the course or a defined access period, as communicated upon purchase. If you are on a payment plan and miss a payment, we reserve the right to suspend your access until the payment issue is resolved.
  • No Guaranteed Refunds: If It Is Math™ operates a no money-back guarantee policy. All sales and enrollments are considered final. We do not guarantee any refunds or money-back offers once a course or service has been purchased. In particular, we do not guarantee score improvements or any specific outcomes, and thus we do not offer refunds based on dissatisfaction with your results or progress.

Note: While If It Is Math™ operates a general no-refund policy, this does not affect any rights you may have under consumer protection laws. To the extent such laws grant you non-waivable statutory rights, those rights will prevail.
  • Refunds at Company Discretion: Any request for a refund or credit will be evaluated on a case-by-case basis, and any refund granted will be solely at the Company’s discretion. Generally, refunds or partial refunds may be considered only in exceptional circumstances (for example, if the Company cancels a course or is unable to provide the service purchased due to unforeseen issues). The Company is under no obligation to grant a refund in cases of scheduling conflicts, change of mind, or if the student fails to use the purchased materials.
  • Procedure for Refund Requests: If you believe you have extraordinary circumstances meriting a refund, you may contact our support team at the contact information provided in these Terms. You must include your account information, purchase details, and the reason for the request. We make no promise that a refund will be given, and any decision to provide a refund or credit shall not constitute a waiver of this no-refund policy for future instances.
  • Right to Refuse Service: Please note that the Company reserves the right to refuse service to any student or customer for any reason (or no reason) at any time, without obligation to disclose the reason. In such cases, if the refusal or termination of service occurs without any breach of these Terms by the student, the Company may provide a refund of any prepaid fees for unused services, but this is at the Company’s sole discretion. If the termination is due to a violation of these Terms or misconduct by the student, no refund will be issued.

If we refuse service or terminate without a violation of these Terms, we will refund prepaid fees for unused services. Refunds are not provided in cases of student misconduct or violations of these Terms.

By making a purchase, you acknowledge and accept this Refund Policy. We encourage you to carefully review course details and ask any questions before purchase, as all sales are generally final. This policy does not affect any rights you may have under consumer protection laws that cannot be waived or limited by contract.

  1. Intellectual Property Rights and Content License

All content provided through If It Is Math™ – including but not limited to videos, lectures, texts, questions, explanations, software, images, graphics, logos, and interactive features – is the intellectual property of the Company or its licensors, unless otherwise indicated. These materials are protected by copyright, trademark, and other intellectual property laws. The Company retains all rights, title, and interest in and to its content and Services.

  • License to Use Content: Subject to your compliance with these Terms and payment of any applicable fees, If It Is Math™ grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the course materials and content for which you have enrolled or subscribed, solely for your own personal, non-commercial educational use. This license is provided for the duration of your authorized access period to the course or service. Sharing or transferring your license (or login credentials) to anyone else is strictly prohibited.
  • Restrictions on Use: Except as explicitly permitted by the Company, you must not do any of the following with our content or Services, without prior written consent from If It Is Math™:
  • Reproduce, download, distribute, or publicly display any course materials or content (other than through normal viewing within the platform).
  • Modify, translate, adapt, or create derivative works based on the content.
  • Remove, alter, or obscure any copyright, watermark, or other proprietary notices on the content.
  • Record, screenshot, or otherwise copy video lectures or live sessions (except where the platform provides a download or replay option).
  • Share course materials (including practice questions and tests) with individuals who are not enrolled, or post our proprietary materials on any public forum or website.
  • Use the content for any commercial purpose or for the benefit of any third party; you cannot resell or exploit our content in any manner.
  • Reverse-engineer, decompile, or attempt to extract the source code of any software or platform feature provided by the Service.

Any use of the Services or content that is not expressly permitted by these Terms is considered an unauthorized use. Unauthorized use infringes on the Company’s intellectual property rights and constitutes a breach of these Terms.

  • Company’s Ownership: These Terms do not grant you any ownership of the content or intellectual property you access. All rights not expressly granted to you are reserved by If It Is Math™ and its licensors. You acknowledge that the If It Is Math™ name, logo, and all related product and service names, design marks, and slogans are trademarks or service marks of the Company or its affiliates. You are not permitted to use any of these marks without prior written approval from the rights holder.
  • User Feedback and Submissions: If you submit any ideas, feedback, suggestions, or other content to If It Is Math™ (for example, suggestions to improve a course, or content posted in a user forum), you grant the Company a worldwide, perpetual, irrevocable, royalty-free license to use and incorporate your submissions in any manner. The Company is not obligated to use or acknowledge any submission, and you will not be entitled to any compensation for any use of your feedback or suggestions. For clarity, this clause does not apply to your answers to course exercises or personal data, which are handled as described in the Privacy section; it applies to voluntary communications such as improvement suggestions or testimonials.

Any violation of this Section (Intellectual Property & License) may result in immediate termination of your access to the Services without refund, and may also constitute infringement of the Company’s rights for which we reserve all legal remedies.

  1. Privacy and Data Use

In case of any inconsistency between these Terms and the Privacy Policy, the Privacy Policy governs all matters of personal data and data protection.

Your privacy is important to us. If It Is Math™ collects, uses, stores, and discloses personal information in accordance with applicable data protection laws and our Privacy Policy (if available on our website). By using the Services, you consent to the collection and use of information as outlined below and in the Privacy Policy.

  • Compliance with Laws: We are committed to complying with relevant privacy laws and regulations, including UAE data protection laws and any other laws applicable to our operations. For users in other jurisdictions, we also aim to adhere to widely recognized data protection principles (for example, GDPR principles for EU users) when feasible. We will not knowingly collect more personal data than is necessary to provide our Services and improve the student experience.
  • Personal Data Collection: During account registration and usage, we may collect personal information such as the student’s name, email, age (to verify eligibility), and guardian contact info (for minors). We also collect data related to course performance (scores, progress, attendance) and any content you submit or upload (answers, messages, etc.). All personal information is handled with care and used only for legitimate educational and operational purposes.
  • Use of Data: Personal data collected from students and parents is used primarily to deliver the Services – e.g., to enroll you in courses, track progress, provide support, and communicate updates. We may also use this data to improve our offerings and for internal research on educational efficacy. Any research or analysis reports will use anonymized or aggregated data. For example, the Company may analyze quiz results across many students to improve course content; in doing so, we would not publicly disclose any student’s identity. By using our Services, you agree that the Company may use your de-identified data for such purposes of course improvement and educational research.
  • Anonymized Research and Testimonials: We may share overall insights drawn from student performance (e.g. average score improvements) for marketing or academic research, but this will not include personally identifying information without consent. If we wish to use a specific user’s results or comments as a testimonial or case study, we will seek that user’s (or their parent’s) permission before associating their name or identity with the information. Otherwise, data used externally will be anonymized.
  • Recorded Sessions and Materials: Please note that live online sessions (such as live cohort classes or tutoring sessions) may be recorded by the Company for quality assurance, training, and record-keeping purposes. These recordings help us monitor instructor performance and improve the course content. We may also review any submitted assignments, answers, or communications on our platform as part of our quality control and staff training. By participating in any live session, you (or your parent, if you are a minor) consent to such recordings. Recorded sessions are treated as confidential and are used internally; they are not shared publicly without additional consent. However, we reserve the right to use excerpts or summaries from sessions (with personal identifiers removed) for staff training or to ensure the academic integrity of our programs.
  • Protection of Data: We implement reasonable security measures to protect personal data from unauthorized access or disclosure. Despite these measures, no system can be 100% secure, so we cannot guarantee absolute security of your information. You are responsible for maintaining the confidentiality of your account credentials, as noted in the Account section above.
  • Parental Access: If you are a parent or guardian who has created an account for a minor, you have the right to access and update the personal information associated with that account. You may also request deletion of your child’s personal data, subject to our need to maintain certain records for legal or internal purposes. To exercise these rights, please contact us using the information in the Contact section.

For more details about how we handle personal data, please review our full Privacy Policy (if provided separately on our site). By using the Services, you acknowledge that you have read and understood our data practices as described in these Terms and the Privacy Policy. If you do not agree with our data handling practices, please do not use the Services.

  1. Disclaimers of Warranties

If It Is Math™ provides its Services with a focus on quality and educational effectiveness, but we make no guarantees or warranties about your individual results or the outcomes you will achieve. All Services, content, and materials are provided on an "as is" and "as available" basis to the fullest extent permitted by law.

  • No Guarantee of Results: We do not guarantee that your SAT scores will improve, that you will achieve a certain score, or that you will gain admission to any college or program as a result of using our Services. Each student’s success depends on many factors outside our control, including starting skill level, effort, and test conditions. Any examples of past student success are not promises that you will experience the same.
  • General Disclaimer: If It Is Math™ disclaims all warranties and representations, express or implied, regarding the Services. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the content is error-free, that the Services will be uninterrupted or secure, or that any defects will be corrected. While we strive for accuracy, we do not guarantee that the instructional materials (such as practice questions or answers) are free of mistakes.
  • Technical Reliability: We make reasonable efforts to keep the online platform operational and accessible at all times, but we do not warrant that the Services will be available continuously or that access will be free from technical glitches or downtime. Scheduled maintenance, outages, or internet issues may occur. The Company shall not be responsible for any delay or failure in performance resulting from events outside our reasonable control, such as network failures, third-party service issues, or force majeure events.
  • Third-Party Content: Our Services may include references or links to third-party resources (for example, links to external practice question sources or educational websites). These are provided for convenience and do not signify endorsement. If It Is Math™ is not responsible for the availability, accuracy, or content of third-party sites or resources. Accessing any third-party content is at your own risk.
  • No Academic or Professional Advice Warranty: Any advice or information (such as college admissions guidance or test-taking strategies) provided as part of our Services is for general informational purposes. While our instructors are knowledgeable, they are not providing professional advice tailored to your unique situation. You should use your own judgment and, if necessary, seek additional professional advice when making significant decisions based on our content.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above disclaimers may not fully apply to you. In such cases, any implied warranties are limited to the minimum scope and duration permitted by law.

  1. Limitation of Liability

To the maximum extent permitted by law, If It Is Math™ (including our employees, instructors, affiliates, and partners) will not be liable for any indirect, consequential, incidental, special, punitive, or exemplary damages arising out of or in connection with your use of the Services. This includes, without limitation, any loss of opportunity, lost profits, data loss, or damage to reputation, even if we have been advised of the possibility of such damages.

  • Cap on Liability: In all cases, the total aggregate liability of If It Is Math™ for any claim arising out of or relating to the Services or these Terms (whether in contract, tort, or any other theory of liability) is limited to the amount you paid to the Company for the specific course or service that gave rise to the claim. If the Services were provided to you without charge, the Company’s total liability will be zero, to the extent permitted by law.
  • No Liability for Certain Risks: You acknowledge that there are inherent risks in online education, such as connectivity issues or unauthorized access to your account, and you assume responsibility for any harm resulting from those risks. The Company will not be liable for any issues beyond our direct control, such as technical malfunctions on the user’s side or failure of third-party platforms integrated with our Services. We also will not be liable for any claim relating to any academic or admissions decisions made by third parties (such as colleges or testing agencies), even if you believe those decisions were influenced by your use (or non-use) of our Services.
  • Reliance on Content: Any reliance you place on our practice questions, explanations, or any other content is at your own discretion and risk. If It Is Math™ is not liable for any errors or omissions in the content, or for how you apply the knowledge gained from the Services in any actual test scenario.

This limitation of liability is a fundamental part of the agreement between you and If It Is Math™ and reflects a fair allocation of risk. The Services would not be provided to you without such limitations. Some jurisdictions do not allow the exclusion or limitation of liability for certain damages; in such jurisdictions, the liability of If It Is Math™ will be limited to the fullest extent permitted by law.

  1. Termination and Suspension of Service

If It Is Math™ reserves the right to suspend or terminate your account and access to the Services at any time, for any reason, with or without prior notice, as permitted by law. This section outlines how and why we might terminate or suspend service:

  • Termination by the Company: We may terminate or suspend your use of the Services (including blocking access to course materials or removing your account) immediately and at our sole discretion if you breach any of these Terms or if we determine such action is appropriate. Grounds for termination include, but are not limited to:
  • Violation of the Account Rules or License Restrictions described above (for example, sharing account access, copying content, or other unauthorized use of our materials).
  • Providing false registration information, or impersonating another person.
  • Engaging in abusive, harassing, or inappropriate behavior toward instructors, staff, or other students in any communication on our platform.
  • Any attempt to disrupt the platform, introduce malicious code, or otherwise compromise the security or integrity of our systems.
  • Non-Payment: Failure to pay fees when due (including if a payment method is declined and not promptly corrected) may result in suspension of access until the issue is resolved. If payment is not brought up to date within a reasonable period, we may terminate the enrollment.
  • Legal Compliance: If required by law enforcement, court order, or if we believe you are using the Services for unlawful purposes, we may terminate your access.

In addition to the above specific causes, If It Is Math™ reserves the right to refuse service or terminate accounts at our sole discretion for any reason or no stated reason at all. This means we can decide to discontinue providing Services to you even in the absence of a specific breach of these Terms (for example, if we decide to discontinue a particular course or offering, or if we have concerns about continued provision of service to you). We will endeavor to act fairly and, when reasonable, provide a notice or explanation; however, we are not obliged to provide notice or reasons prior to termination.

  • Effect of Termination: If your account is terminated or suspended:
  • Your right to access the Services will cease immediately. You must stop using any course materials that have not been fully downloaded or saved prior to termination.
  • We may revoke your license to use the content, and you must delete any downloaded materials obtained through the Service (except for any of your own notes or submissions).
  • Any fees paid are non-refundable except at our discretion as stated in the Refund Policy. If termination was initiated by us without cause (i.e. not due to your breach), and you have unused portion of a paid service, we may decide to provide a pro-rated refund for the unused portion, but we are not obligated to do so.
  • We also reserve the right to reclaim your username or account ID at termination.
  • User-Initiated Termination: You may stop using the Services and/or close your account at any time. If you wish to terminate your account, you should notify us or use any available account deletion function. Note that simply ceasing to use the Services does not entitle you to a refund of any fees paid. The Refund Policy in Section 6 will apply to any cancellation or withdrawal.
  • Surviving Terms: Even after termination of your account or access, certain provisions of these Terms will continue to remain in effect by their nature. These include (but are not limited to) provisions on Intellectual Property (Section 7), Payments due, Disclaimers (Section 9), Limitation of Liability (Section 10), Governing Law (Section 12), and any other clauses that are necessary to interpret or enforce the agreement after termination.

Termination or suspension of an account is a tool we use to protect the integrity of our Services and community. If you believe your account was terminated in error, you may contact us to request reconsideration, but If It Is Math™’s decision in such matters will be final. The Company shall not be liable to you or any third-party for any termination of your account or access to our Services.

  1. Governing Law and Dispute Resolution

This Agreement and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with the Services or these Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates (UAE), without regard to its conflict of law principles. By using the Services, you agree that the laws of the UAE will apply to all matters relating to your use of the Services.

  • Jurisdiction: You agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services will be subject to the exclusive jurisdiction of the courts of the United Arab Emirates. If you are accessing the Services from outside the UAE, you are responsible for complying with any local laws that may apply, but to the extent permitted, any claims will be litigated in the UAE. You waive any objections to the exercise of jurisdiction by UAE courts or to the venue of such proceedings on grounds of inconvenient forum or any similar doctrine.
  • Injunctive Relief: Notwithstanding the above, If It Is Math™ may seek injunctive or other equitable relief in any jurisdiction in order to protect its intellectual property or confidential information.
  • Good Faith Negotiation: Before initiating any legal action, we encourage you to contact us to discuss and attempt to resolve the issue in good faith. Often, disputes or concerns can be addressed through our support team without formal proceedings.
  • No Class Actions: You agree to resolve disputes with If It Is Math™ on an individual basis. To the fullest extent permitted by law, you waive the right to participate in any class-action lawsuit or class-wide arbitration against the Company, either as a plaintiff or class member. All claims must be brought in the parties’ individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

If any provision of this Governing Law and Dispute Resolution section is found to be illegal or unenforceable, that provision will be severed, and the remainder of this section will be enforceable to the fullest extent allowed by law.

  1. Miscellaneous Provisions

Entire Agreement: These Terms (along with any additional policies, guidelines, or rules that we expressly incorporate by reference, such as our Privacy Policy or any course-specific terms) constitute the entire agreement between you and If It Is Math™ regarding the Services. They supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and the Company regarding the Services. Any other information or advertising you may have seen is not part of these Terms unless expressly incorporated herein.

Changes to Terms: The Company may update or modify these Terms from time to time. If we make material changes, we will provide notice by posting the updated Terms on our website, and updating the “Last Updated” date at the top, or by other appropriate means. It is your responsibility to review the Terms periodically. By continuing to use the Services after any changes become effective, you agree to be bound by the revised Terms. If you do not agree with a change, you must stop using the Services.

Severability: If any provision of these Terms is held by a court of competent jurisdiction to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions of these Terms will remain in full force and effect. The parties agree that any such invalid provision shall be deemed severable and shall not affect the validity and enforceability of any remaining terms.

No Waiver: The failure of If It Is Math™ to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of If It Is Math™.

Assignment: You may not assign or transfer your rights or obligations under these Terms to anyone else without our prior written consent. We may assign our rights and obligations to an affiliate or in connection with a merger, acquisition, reorganization, or sale of assets, or by operation of law or otherwise. These Terms will inure to the benefit of and be binding upon each party’s successors and permitted assigns.

No Third-Party Beneficiaries: These Terms are intended for the benefit of you and If It Is Math™ and not for the benefit of any third party or any other person.

Notices: Communications from If It Is Math™ to you may be made via email to the address associated with your account, or via notifications within the platform. You consent to receive electronic communications from us for all purposes. If you have questions or need to contact us for any reason (including legal notices), you may do so at the contact information provided on our website or as follows: [email protected].

Language: These Terms are provided in the English language. If we provide a translation of these Terms into any other language, the English language version will prevail to the extent of any conflict.
